Unlike a standard enclosed dry van trailer, a flatbed truck leaves its massive cargo completely exposed to the elements and highway forces. Flatbeds routinely transport enormous, deadly freight: stacks of lumber, 40,000-pound steel coils, concrete pipes, and heavy construction machinery. If this cargo shifts during a turn or snaps its tie-downs on the highway, it will violently crush any passenger vehicles in its path.

When a catastrophic "load shift" or "dropped cargo" accident occurs, a vicious legal battle immediately erupts between the driver, the trucking company, and the warehouse that loaded the freight.   • Supplying Defective Dunnage: "Dunnage" refers to the wood blocks or friction mats used to prevent metal-on-metal sliding. If the loading facility supplied rotted wood blocks that snapped under pressure, they are directly responsible for the load failure.

The Motor Carrier's Responsibility

The trucking company itself is legally responsible for providing the driver with Working Load Limit (WLL) rated equipment. If the company provided frayed nylon straps, rusted chains, or defective winch binders that snapped under the weight of the load, the corporation is fully liable for negligent maintenance and failing to properly train their driver on FMCSA flatbed securement mathematics.
